Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Meal Planner - Plan4Meals mobile application ("App"), operated by Joana Lima Dourado ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 18 years old to use this App. By using the App, you represent that you meet this requirement.

2. User Accounts

To access certain features, you must create an account. You are responsible for:

• Providing accurate and complete information during registration.
• Keeping your login credentials confidential.
• All activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations.
• Attempt to gain unauthorised access to any part of the App or its related systems.
• Upload content that is unlawful, harmful, offensive, or infringes the rights of others.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use the App to distribute spam, malware, or any harmful content.

4. User-Generated Content

The App allows you to upload photos and create recipes ("User Content"). By submitting User Content, you grant us a non-exclusive, royalty-free licence to store and display your content solely for the purpose of providing the App's services to you.

You retain ownership of your User Content. You are solely responsible for ensuring that your content does not violate any third-party rights or applicable laws.

5. AI Features

The App uses artificial intelligence (AI) powered by Google's Gemini API to provide features such as recipe scanning and weekly meal planning suggestions. AI-generated content is provided for informational purposes only and may not always be accurate. We do not guarantee the quality, accuracy, or suitability of AI-generated meal suggestions or extracted recipe information.

6. Subscriptions and Payments

The App may offer premium subscription plans processed through Google Play. By subscribing, you agree to the pricing, payment, and billing terms presented at the time of purchase.

• Subscriptions automatically renew unless cancelled before the renewal date.
• You may cancel your subscription at any time through your Google Play account settings.
• Refunds are subject to Google Play's refund policy.

7. Intellectual Property

All content, design, code, and trademarks in the App (excluding User Content) are owned by or licensed to us. You may not copy, reproduce, distribute, or create derivative works from any part of the App without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.

9. Third-Party Services

The App integrates with third-party services including Google Firebase, Google Sign-In, and Google Gemini API. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of any third-party services.

10. Disclaimers

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• Any information provided through the App, including AI-generated content, is accurate or complete.
• The App will meet your specific requirements.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the six (6) months preceding the claim.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through informal negotiations for a period of 30 days. If unresolved, disputes shall be submitted to binding arbitration in Beja, Portugal, conducted in Portuguese, in accordance with applicable arbitration rules.

For users in the European Union, nothing in these Terms limits your rights under applicable EU consumer protection laws.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

15. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of significant changes by email or through a notice in the App. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

16. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.
